Client Injured in Tractor-Trailer Accident Wins Six Figure Settlement

In April 2019, it started out as just another day for Lonnie.  He was driving his Ford Focus on Highway 56 in Baxter, Tennessee where he lives. Lonnie is a wonderful musician and plays in a band in the Cookeville, Tennessee area. On this April day, Lonnie could never have guessed what would happen next.

A tractor-trailer, sometimes called a big rig or eighteen wheeler, came down an Interstate 40 exit ramp and failed to stop at the intersection where Lonnie was located. The tractor-trailer t-boned Lonnie’s Ford Focus with incredible force, moving Lonnie’s car all the way across the intersection and into the grass.  Lonnie’s car was completely totaled and he was hurt.  First responders assessed Lonnie and determined he needed to be taken by “Life Flight” to Vanderbilt University Medical Center.  He was at Vanderbilt overnight having suffered a collapsed lung and musculoskeletal injuries.

With painful injuries and his medical bills about to pile up Lonnie was stressed and unsure what to do.  So he called Weir & Kestner Injury Lawyers on a Sunday. Our injury team connected Lonnie to an attorney immediately. On Monday, Attorney Joe Weir personally met with Lonnie in Albany, Kentucky where he was staying to recover.  Lonnie was scared that he wouldn’t be able to play music again. Joe told Lonnie to just focus on getting better and that Weir & Kestner Injury Lawyers would take care of the rest.

Weir & Kestner Injury Lawyers immediately began investigating the tractor-trailer accident, and placed the insurance carrier on notice that all evidence must be preserved. The investigation revealed the tractor-trailer had bad brakes, and worse, the owner of the big rig likely knew the brakes were bad.  Knowingly using a tractor-trailer with bad brakes constitutes a reckless disregard for the safety of the general public.

Using the results of the investigation, Weir & Kestner Injury Lawyers aggressively executed a pre-litigation strategy and prosecuted the claim to the fullest extent of the law.  With his stress gone, Lonnie made a complete recovery. The pre-litigation strategy forced the insurance carrier to pay a sizeable six-figure settlement (amount is confidential).

Weir & Kestner held the tractor-trailer’s insurance carrier accountable and helped another client protect his injury rights.  Weir & Kestner Injury Lawyers has helped thousands locally and recovered millions for clients just like Lonnie. Win Your Case.  Lose Your Stress.
